Terms of Service
Effective July 29, 2026. These terms are a binding agreement between you and Homeowner Henry. Please read them, especially the arbitration and class action waiver in Section 14.
These Terms of Service ("Terms") govern your access to and use of homeownerhenry.com and the contractor matching service offered through it (the "Service"), operated by Homeowner Henry ("Homeowner Henry," "we," "us," or "our"). By using the Service or submitting a project request, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1.Eligibility and acceptance
You must be at least 18 years old, a resident of the United States, and legally able to enter into contracts to use the Service. If you use the Service on behalf of a business or another person, you represent that you have authority to bind that party to these Terms. Requests for work at a property require that you own the property or are authorized to arrange work on it.
2.What the Service is — and what it is not
- We collect the project details you submit and introduce you to a limited number of independent, third-party contractors ("Pros") we believe may be able to help.
- We are not a contractor, home improvement company, general contractor, construction manager, employer of any Pro, insurer, lender, broker, or agent for either you or a Pro.
- We do not perform, supervise, direct, schedule, price, inspect, warrant, or guarantee any work. We do not endorse or recommend any particular Pro.
- Any contract for work is solely between you and the Pro. Homeowner Henry is not a party to it and has no responsibility or liability under it.
- A match is not a guarantee that a Pro will contact you, provide an estimate, accept your project, be available, quote a particular price, or complete work to your satisfaction.
3.Vetting disclosure — what our screening does and does not mean
We apply screening criteria to Pros in our network, which may include checking that a business license is on file where required, requesting proof of general liability insurance, reviewing publicly available reviews and complaint history, and tracking homeowner feedback and no-show reports. Screening is performed at a point in time and relies substantially on information supplied by the Pro and on third-party sources that may be incomplete, out of date, or inaccurate.
Screening is not a guarantee of a Pro's licensure, insurance status, bonding, workmanship quality, honesty, pricing, safety record, or continued compliance. You are solely responsible for your own due diligence before hiring anyone. We strongly recommend that you independently verify license and insurance status with your state or local licensing authority, obtain multiple written estimates, check references, confirm permits, review lien and warranty terms, and never pay in full before work is completed.
4.Your consent to be contacted
By submitting a request, you expressly consent to be contacted by Homeowner Henry, the matched Pros, and their authorized service partners at the phone number and email address you provide — including by automatic telephone dialing system, artificial, AI-generated, or prerecorded voice, and by SMS or MMS text message — regarding your project and related home services, even if the number is registered on a federal, state, or corporate Do Not Call list. Consent is not a condition of purchasing any goods or services. Message and data rates may apply and message frequency varies. Reply STOP to opt out of texts and HELP for help, use the unsubscribe link in emails, or contact us as described in the Privacy Policy. You represent that the phone number you submit belongs to you and that you will notify us if it changes or is reassigned.
5.Your responsibilities and acceptable use
- Provide accurate, current, and complete information, and keep it updated.
- Do not submit requests for anyone else without their permission, or use another person's contact information.
- Do not use the Service for unlawful, fraudulent, harassing, or competitive data-harvesting purposes.
- Do not scrape, crawl, reverse engineer, overload, probe, or interfere with the Service, its security features, or its infrastructure.
- Do not submit false, defamatory, infringing, or misleading content, including fake reviews or complaints.
- Do not resell, sublicense, or redistribute leads, listings, or other content from the Service.
We may refuse, suspend, or terminate access to the Service at any time, with or without notice, for any reason, including suspected violation of these Terms.
6.Pricing, estimates, and cost information
Any cost ranges, averages, or estimates shown on the Service are general national or regional illustrations for informational purposes only. They are not quotes, offers, appraisals, or guarantees of price. Actual pricing depends on your project, materials, local labor rates, permits, and site conditions, and is set solely by the Pro.
7.How we make money
The Service is free to homeowners. We are compensated by participating Pros, generally through membership or per-match fees, and we may earn compensation from marketing partners. Compensation may influence which Pros are available in a given area, but it does not change the screening standards described in Section 3 and does not create any agency, partnership, joint venture, employment, or franchise relationship between us and any Pro.
8.Reviews, feedback, and user content
If you submit reviews, photos, complaints, testimonials, or other content, you represent that it is truthful, based on your own experience, and that you own or have the right to submit it. You grant Homeowner Henry a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, modify, publish, and display that content in connection with operating and promoting the Service, including in anonymized or excerpted form. We may, but are not obligated to, review, edit, or remove content. We do not condition any benefit on writing a positive review, and we do not suppress reviews solely because they are negative.
9.Intellectual property
The Service and all of its content — including the Homeowner Henry name, logo, text, graphics, layouts, and software — are owned by Homeowner Henry or its licensors and are protected by copyright, trademark, and other laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Service for your personal, non-commercial purpose of finding home services. All other rights are reserved. If you believe content on the Service infringes your copyright, send a notice under the DMCA (17 U.S.C. § 512) to legal@homeownerhenry.com including the required elements: identification of the work, the infringing material and its location, your contact information, a good-faith statement, a statement of accuracy under penalty of perjury, and your signature.
10.Third-party sites and services
The Service may link to or integrate third-party websites and services. We do not control them, do not endorse them, and are not responsible for their content, products, practices, or agreements. Your dealings with third parties are solely between you and them.
11.Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND ALL CONTENT, MATCHES, AND INFORMATION ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, WORKMANLIKE PERFORMANCE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY INFORMATION IS ACCURATE OR COMPLETE. WE MAKE NO WARRANTY REGARDING ANY PRO OR ANY WORK, GOODS, ESTIMATES, PRICING, TIMELINESS, LICENSURE, INSURANCE, OR CONDUCT OF ANY PRO. Some jurisdictions do not allow the exclusion of certain warranties, so some exclusions may not apply to you.
12.Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOMEOWNER HENRY AND ITS OFFICERS, EMPLOYEES, AGENTS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, PROPERTY DAMAGE, PERSONAL INJURY, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO THE SERVICE OR ANY INTERACTION WITH A PRO, WHETHER BASED IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). These limits apply even if a remedy fails of its essential purpose. Nothing in these Terms limits liability that cannot be limited under applicable law, including for fraud or willful misconduct, and some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
13.Indemnification
You agree to defend, indemnify, and hold harmless Homeowner Henry and its officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your content, your dealings or contracts with any Pro, your breach of these Terms, or your violation of any law or the rights of a third party.
14.Dispute resolution, arbitration, and class action waiver
Informal resolution first. Before filing a claim, you agree to contact us at legal@homeownerhenry.com with a written description of the dispute and to work with us in good faith for 60 days to resolve it.
Binding arbitration. If we cannot resolve the dispute, you and Homeowner Henry agree that any dispute, claim, or controversy arising out of or relating to the Service or these Terms will be resolved by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The Federal Arbitration Act governs this section. Arbitration will take place in the county where you reside or by videoconference or documents-only submission at your election, and the arbitrator may award any relief available in an individual court action.
Class action and jury trial waiver. YOU AND HOMEOWNER HENRY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING, AND THAT EACH WAIVES THE RIGHT TO A JURY TRIAL. If this waiver is found unenforceable as to a particular claim, that claim will proceed in court and the rest of this section still applies.
Exceptions. Either party may bring an individual claim in small claims court, and either party may seek injunctive relief in court for intellectual property misuse or unauthorized access. Nothing here prevents you from filing a complaint with a government agency.
30-day opt-out. You may opt out of this arbitration and class waiver section by emailing legal@homeownerhenry.com with your name, address, and a clear statement that you opt out of arbitration, within 30 days of first accepting these Terms. Opting out will not affect any other part of these Terms.
15.Governing law and venue
These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law rules, except that the Federal Arbitration Act governs Section 14. For any dispute not subject to arbitration, the state and federal courts located in Delaware will have exclusive jurisdiction, and you consent to personal jurisdiction there. Nothing in this section deprives you of the protection of mandatory consumer protection laws of the state where you reside.
16.Changes to the Service and these Terms
We may modify, suspend, or discontinue any part of the Service at any time. We may also update these Terms; we will change the effective date above and, for material changes, provide reasonable notice. Changes are not retroactive and take effect when posted or on the date stated. Your continued use of the Service after changes take effect means you accept the updated Terms.
17.General terms
If any provision of these Terms is held unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our written consent; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Homeowner Henry regarding the Service. Sections that by their nature should survive termination — including Sections 8, 9, and 11 through 17 — will survive.
